These Terms and Conditions set out the basis on which Rubbish Removal Wembley provides waste collection and rubbish removal services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you must not proceed with a booking or use our services.

1. Definitions

In these Terms and Conditions:

2. Scope of Services

2.3 We do not handle all types of waste. Restricted items may include, but are not limited to, hazardous materials, clinical or medical waste, chemicals, asbestos, gas bottles, pressurised containers, certain electrical items, and any other items we reasonably determine to be unsafe or unsuitable for collection.

3. Booking Process

3.1 You can request a quotation or make a booking by contacting us via telephone, email or any online booking system we make available.

3.2 When making a booking, you must provide accurate and complete information about the type and quantity of waste, location, access restrictions, parking arrangements and any other relevant details.

3.3 Quotations are based on the information you provide. If the actual waste or site conditions differ from what was described, we reserve the right to revise the price or, where necessary, decline to carry out the service.

3.4 A booking is only confirmed when we acknowledge acceptance, allocate a time slot, and you accept the quoted price or pricing structure. Any indicative time slots are estimates only and not guaranteed, although we will use reasonable efforts to arrive within the agreed window.

3.5 We may refuse or cancel a booking if we consider the job unsafe, unlawful, impractical, or if you have previously failed to pay for services.

4. Access and Customer Obligations

4.1 You must ensure that our operatives have safe and suitable access to the collection address on the agreed date and time. This includes arranging any necessary permissions for parking and site entry.

4.2 You are responsible for providing clear instructions as to the waste to be removed and for separating any items that are not to be taken.

4.3 Where access is restricted or parking is unavailable, we may charge additional fees for extra time, walking distances, or the need to reschedule.

4.4 You must ensure that the waste has been stored and presented safely and that it does not contain hazardous materials or any excluded items. If such items are found, we may refuse collection of some or all of the waste and apply appropriate charges for time spent on site.

5. Pricing and Quotations

5.1 Prices are generally based on the volume and type of waste, weight where relevant, labour involved, access conditions, and any additional services requested.

5.2 Any quotation provided before attendance is an estimate only, based on the information you supply. The final price will be confirmed by our operative on site once the waste has been inspected.

5.3 If you decline to proceed with the service after our operative has arrived and inspected the waste because the final price differs from an initial estimate, we reserve the right to charge a call-out or attendance fee.

5.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Where VAT applies, it will be added at the prevailing rate.

6. Payments and Invoicing

6.1 Payment is due on completion of the service, unless we agree alternative terms in writing prior to the booking.

6.2 We accept payment by cash, bank transfer, or card payment, subject to the facilities available at the time of service. We reserve the right to specify acceptable payment methods.

6.3 For business customers or account holders, invoices are payable within the agreed credit period. If no period is specified, payment is due within 14 days of the invoice date.

6.4 If you fail to make payment on time, we may charge interest on overdue amounts at the statutory rate allowed for late payment of commercial debts, and we may suspend further services until all outstanding sums are settled.

6.5 You are responsible for all costs and expenses we incur in recovering overdue payments, including reasonable debt collection and legal costs.

7. Cancellations and Rescheduling

7.1 You may cancel or reschedule a booking by contacting us directly. We ask that you provide as much notice as reasonably possible.

7.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation charge will usually apply.

7.3 If you cancel less than 24 hours before the scheduled arrival time, fail to provide access, or are not present where your attendance is required, we may charge a cancellation or wasted journey fee to cover our costs.

7.4 We may cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to vehicle breakdowns, extreme weather, traffic disruptions, accidents, staff illness, or regulatory restrictions. In such cases, we will use reasonable efforts to notify you and arrange an alternative time. We will not be liable for any loss arising from such cancellations or delays.

8. Waste Regulations and Duty of Care

8.1 We operate in accordance with applicable UK waste management and environmental legislation and will only dispose of waste at licensed facilities.

8.2 You confirm that you are either the owner of the waste or have full authority from the owner to arrange its removal and disposal.

8.3 You must not knowingly request us to remove waste that is unlawful to handle or dispose of through our services, including hazardous or controlled waste for which we are not licensed.

8.4 We may issue a waste transfer note where required by law or where we consider it appropriate. You must provide any information reasonably requested to complete such documentation.

8.5 Once we have removed the waste from your premises, title to and responsibility for that waste transfers to us, and we will manage it in line with relevant regulations. This does not limit your liability if you have misdescribed the waste or concealed prohibited items.

9. Customer Property and Site Condition

9.1 You must remove or clearly identify any items that are not to be taken. Our operatives will exercise reasonable care, but we cannot be held responsible if items are inadvertently removed where they were mixed with waste clearly presented for disposal.

9.2 Our service does not include deep cleaning, repairs, or making good any surfaces beyond taking reasonable care when removing waste. Minor scuffs or marks can sometimes occur in confined spaces, and we are not liable for such minor cosmetic damage unless caused by our negligence.

9.3 You are responsible for ensuring that the site is reasonably clear of hazards and that any fragile, high-value or delicate items are appropriately protected or moved out of the work area before we begin.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded by law.

10.2 Subject to clause 10.1, we will not be liable for any indirect, consequential, or purely economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the services we provide.

10.3 Our total aggregate liability to you in respect of any claim arising out of our services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by you for the specific job to which the claim relates.

10.4 We will not be liable for delays, cancellations, or failure to perform our obligations where such failure is caused by events beyond our reasonable control, including but not limited to severe weather, traffic incidents, acts of government, industrial action, or other force majeure events.

11. Complaints and Service Issues

11.1 If you have any concerns or complaints about our services, you should contact us as soon as possible, providing full details of the issue and any supporting information.

11.2 We will investigate complaints promptly and aim to resolve them in a fair and reasonable manner. Where appropriate, we may offer to revisit the site, rectify any agreed issues, or provide a partial refund or other remedy at our discretion.

11.3 Raising a complaint does not entitle you to withhold payment for services already properly provided, unless and until we agree to an adjustment.

12. Insurance

12.1 We maintain suitable insurance cover in connection with the operation of our waste collection services, including public liability insurance to a reasonable level.

12.2 Our insurance does not replace or reduce your responsibility to maintain appropriate insurance for your own property, premises, and any items located there.

13. Data Protection and Privacy

13.1 We will collect and use personal information you provide to us, such as contact details, for the purposes of arranging and delivering our services, managing accounts, and handling enquiries or complaints.

13.2 We will take reasonable steps to keep your personal information secure and to process it in accordance with applicable data protection laws.

13.3 We may retain records of bookings, invoices, and related information for as long as necessary to comply with legal and accounting requirements.

14. Variation of Terms

14.1 We may amend these Terms and Conditions from time to time. Any updated version will apply to future bookings and services from the date it is made available.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or confirmation of booking, set out the entire agreement between you and us in relation to the provision of our services and supersede any prior understandings or representations.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or the services we provide, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
